The increased backlash against the significant gains of the trans rights movement has started seeping into many different areas of law. Increasingly, nontransgender spouses and nonaffirming parents of transgender children are using their spouse’s or child’s transgender status to restrict their access to their children and to transition-related care. This panel will give an overview on the many issues facing transgender and gender nonconforming children and parents involved in custody proceedings. Panelists will give an overview of the state of the current law, discuss recent case law, and discuss challenges and strategies for continued litigation of these cases.
