Identity document policies have progressed significantly over recent years, and transgender people have better access than ever to accurate IDs without excessive legal or medical gatekeeping. However, judges and the courts are still instrumental to the process of updating identity documents in several important ways: name changes almost invariably have to go through the court system, and in many states trans people are forced to get a court-ordered change of gender to correct a particular document. Hear from lawyers on the front lines of ID document work about the considerations for representing transgender clients in obtaining a court order for name or gender change and the challenges of accessing them in different states, as well as counseling them in the process for updating their identity documents at both the state and federal level. Join our conversation highlighting the scope and history of gender marker change cases, exploring compelling legal arguments, and discussing when and when not to bring gender change cases to the courts.
