Plaintiff, a transgender Transportation Security Officer (“TSO”), filed suit against the Department of Homeland Security alleging employment discrimination under Title VII of the Civil Rights Act and challenging the Trump administration’s directive prohibiting transgender TSO’s from performing passenger pat-downs and from using restrooms aligned with their gender identity. The prohibition on pat-downs and bathroom usage by trans TSA employees was implemented on February 7, 2025 based on Executive Order 14168, “Defending Women from Gender Ideology [etc.].” The plaintiff initiated her administrative EEO complaint on February 7, and after exhausting administrative remedies, filed suit in the federal district court for the Eastern District of Virginia.
